These Terms & Conditions ("Terms") constitute a legally binding agreement between you ("User", "you") and PINTOOF LEGAL AND TECHNOLOGICAL PRIVATE LIMITED ("Pintoofpay", "we", "us", "our"), the operating entity of the Pintoofpay platform, having its registered office at Bhopal, Madhya Pradesh - 462038, India.
1. Acceptance of Terms
By creating a Pintoofpay account, accessing our mobile application, scanning a Pintoofpay QR code, or otherwise using any service made available through the platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, you must discontinue use of the platform immediately.
2. Description of Services
Pintoofpay is a closed-wallet utility platform that enables stored value to be used for the following purposes:
- Zero-fee peer-to-peer (P2P) wallet transfers between verified Pintoofpay users via mobile number, Pintoofpay ID, or QR code.
- Scan-and-pay merchant QR transactions within the closed-loop ecosystem.
- Utility bill payments and recharges through the Bharat Bill Payment System (BBPS), including Electricity, Gas, Water, and Mobile/DTH recharges (Jio, Airtel, Vi).
- Digital passbook access with downloadable PDF transaction statements.
- Merchant and B2B accounts enabling businesses to accept payments with 0% MDR and instant settlement.
3. Eligibility & Account Registration
You must be an Indian resident of at least 18 years of age with a valid mobile number linked to your KYC credentials. You agree to provide accurate, complete, and up-to-date information during registration and to keep your profile information current. Pintoofpay reserves the right to suspend or terminate accounts where KYC requirements prescribed under applicable Reserve Bank of India (RBI) guidelines are not satisfied.
4. Account Security & MPIN
You are solely responsible for maintaining the confidentiality of your MPIN, one-time passwords (OTP), and device credentials. All transfer authorisations require MPIN verification. You must notify us immediately at support@pintoofpay.in if you suspect any unauthorised access to your account. Pintoofpay will never ask for your MPIN via call, SMS, or email.
5. Fees, Charges & MDR
Pintoofpay levies zero convenience fees on wallet-to-wallet P2P transfers. Utility payments are processed at the biller's quoted amount without an additional platform surcharge. Merchant transactions carry 0% MDR. Any charges levied by banks, telecom operators, or BBPS billers for third-party services remain outside Pintoofpay's control and will be disclosed where applicable before you confirm a transaction.
6. Transaction Limits & Digital Ledger
Transaction limits applicable to your wallet are determined by your KYC status and applicable RBI regulations for prepaid payment instruments. The digital passbook maintained by Pintoofpay serves as the primary transaction record. In the event of a discrepancy, you must raise a claim within 30 days of the transaction date so that we may reconcile it against our double-entry ledger records.
7. Prohibited Activities
You agree not to use Pintoofpay for any unlawful or abusive purpose, including but not limited to money laundering, terrorist financing, fraud, gambling, sale of restricted goods, or any activity prohibited under the Prevention of Money Laundering Act, 2002 or the Information Technology Act, 2000. Transactions structuring, duplicate account creation, and manipulation of promotional credits are strictly prohibited and may result in immediate account suspension with funds frozen pending regulatory reporting.
8. Support & Issue Resolution
Our designated Support Head (Grievance Officer) can be reached at support@pintoofpay.in. Grievances are acknowledged and resolved within 24-48 hours of receipt, and in all cases within the timelines prescribed by applicable law. You may escalate unresolved complaints to the relevant consumer forum or the Reserve Bank of India as permitted under applicable regulations.
9. Transaction Confirmation & Liability
Once your MPIN authorises a transaction, it is final and non-reversible except as provided in our Refund & Cancellation Policy or where a technical failure results in debiting without credit at the beneficiary end. Pintoofpay is not liable for delays or failures caused by force majeure events, bank outages, BBPS downtime, telecom failures, or any circumstance beyond reasonable control. Our aggregate liability shall not exceed the balance held in your wallet at the time of the claim.
10. Intellectual Property
The Pintoofpay name, logo, "Pintoof Shield" mark, application interface, and all related content are the exclusive property of PINTOOF LEGAL AND TECHNOLOGICAL PRIVATE LIMITED. No part of the platform may be copied, reproduced, or distributed without prior written consent.
11. Termination
You may close your account at any time by writing to our support mailbox after clearing any pending dues. We may suspend or terminate access where these Terms are breached, where KYC lapses, or where required by law or regulatory direction. Upon termination, any remaining eligible wallet balance will be refunded to your verified bank account in accordance with our refund policy.
12. Limitation of Liability & Disclaimer
The platform is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Pintoofpay disclaims all warranties, express or implied, including merchantability and fitness for a particular purpose. Nothing in these Terms shall limit any liability that cannot be excluded under Indian law, including liability arising out of our own negligence or fraud.
13. Governing Law & Jurisdiction
These Terms are governed by the laws of India. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts at Bhopal, Madhya Pradesh.
14. Amendments & Contact
We may amend these Terms to reflect regulatory changes, security upgrades, or new features. Material changes will be notified through the application or website before they take effect.
